These Terms and Conditions ("Terms") govern your purchase of products and services from AI Art Cook we via aiartcook.com (the "Site"). By placing an order, you agree to these Terms. If you do not agree, do not place an order.1. About Us

2. Products and Descriptions

• We sell digital downloads (high-resolution AI-generated art files) and, as we expand, physical products (hard copies such as posters, canvases, framed prints, and merch like apparel/accessories) fulfilled on-demand via Printify.

• All artwork is AI-generated and creative/artistic. Any resemblance to real persons, places, or works is coincidental. Images are illustrative; colours/appearance may vary slightly due to screens/printers.

• Product descriptions, prices, and availability are approximate and subject to change without notice.

3. Orders and Contract Formation

• Placing an order is an offer to buy. We accept (and form a contract) when we send an order confirmation email.

• We reserve the right to refuse/cancel orders (e.g., pricing errors, stock issues, suspected fraud). If refused, we'll refund any payment.

• You must be 18+ or have parental consent to order.

4. Pricing and Payment

• Prices are in GBP (£) and include VAT where applicable (digital/physical).

• Payment via [e.g., Stripe/PayPal] — we do not store full card details.

• Full payment required at checkout. Title/risk passes on delivery (physical) or download access (digital).

5. Delivery and Fulfilment

• Digital Downloads: Instant access via email/link upon successful payment (usually immediate; up to 10 minutes). See our Shipping Policy (/shipping-policy) for details.

• Physical Products: Produced on-demand via Printify (3–10 business days processing/production) + shipping (2–21 days depending on location). Tracked where available. See our Shipping Policy (/shipping-policy) for full details, times, costs, and international customs.

• We aim for prompt delivery but times are estimates. Delays do not entitle cancellation unless unreasonable under CRA 2015.

6. Your Rights to Cancel (Cooling-Off Period)
Under Consumer Contracts Regulations 2013:

• You have 14 days from receipt (physical) or contract formation (digital) to cancel for a full refund.

• Digital downloads: Right lost if you consent to immediate download and acknowledge loss of cancellation right (checkbox at checkout).

• Physical products: Return unused/unopened within 14 days (you pay return postage unless faulty). For personalised items (e.g., custom sizes/names), no cancellation right post-production start.

• To cancel: Email us at [support@aiartcook.com (mailto:support@aiartcook.com)] with order number. Refund within 14 days of notice (or return receipt for physical).
  Your statutory rights under CRA 2015 (e.g., faulty/not as described) are not affected.

7. Returns, Refunds, and Faulty Products

• Digital: No refunds post-download except for technical faults preventing access (we'll resend/replace file).

• Physical: Report damage/non-delivery within 30 days with photos. We'll arrange replacement/refund/redelivery (Printify handles quality claims).

• Faulty/not as described: Remedies per CRA 2015 (repair/replacement/refund). See our Returns Policy (/returns-policy) if separate.

• No refunds for change of mind on custom/personalised items once produced.

8. Licence and Intellectual Property (Digital Downloads)

• Upon purchase, you receive a non-exclusive, non-transferable, personal licence to use the digital file for: personal, non-commercial printing/display (e.g., home wall art).

• You may not resell, redistribute, commercially exploit, modify for resale, or claim as your own creation.

• All IP (copyright, design rights) remains with us/our licensors. Unauthorised use may result in legal action.

9. Limitation of Liability
To the extent permitted by law:

• We are not liable for indirect/consequential losses (e.g., lost profits).

• Total liability limited to the order value.

• Nothing excludes liability for death/injury (negligence), fraud, or statutory rights under CRA 2015.

• We are not responsible for third-party services (e.g., Printify, payment processors, email delivery issues).

10. Force Majeure
We are not liable for delays/failures due to events beyond control (e.g., strikes, pandemics, carrier issues).11. Governing Law and Disputes
These Terms are governed by Scots law (England and Wales as applicable). Disputes subject to exclusive jurisdiction of Scottish courts.

We may update these Terms. Changes posted here (new effective date). Continued orders = acceptance. Significant changes notified via email/Site.13. Entire Agreement
